Our Responsibility
The obligation of Nozzals® under this warranty, statutory or otherwise, is limited to the replacement or repair of the parts in our facility.
Warranty Limitations
Nozzals® is not responsible for failure resulting from owner or operator's abuse, neglect, such as but not limited to: operation without adequate coolant, fuel lubricants; over-fueling*; over-speeding; lack of maintenance of lubricating, coolant or air intake systems; improper storage, warm-up, run-in, using dirty diesel fuel or shut down practices, improper power supply , power fluctuations. Nozzals® is not responsible for failures resulting from improper repair or installation, for parts that have been altered or for parts not approved by us.
Professional Installation
As a requirement for claims evidence must be provided that already installed parts have been fitted by trained staff in a professional workshop using the special tools intended for this purpose and in accordance with the installation and servicing regulations of the respective manufacturer. Installation instructions included with the product must be observed. If the installation does not meet the generally acknowledged latest technical standards the claim shall not apply, regardless of the respective underlying causes.
Third Party Evaluation
Any unauthorized testing, tampering, evaluating, assessing, altering, gauging, repairing, by anyone will null and void this warranty. We neither assume nor authorize any other persons to assume for us any other liability in connection with our products. WE SHALL NOT BE RESPONSIBLE FOR ANY OTHER CONSEQUENTIAL DAMAGES OR CONTINGENT LIABILITIES. Further, in no event shall Nozzals® bear any responsibility for any damages, which exceed the then available aggregate coverage provided under the terms & conditions of this product liability policy.
Warranty Process
Nozzals® reserves the right to demand the return of the goods object of a warranty claim, and to examine them in its own facilities before a warranty claim is accepted or rejected. Prior to any return shipment we need to express written permission. Any transport cost related to the return of goods under warranty claim shall be borne by the customer, who has a right to demand a corresponding refund if the warranty case is confirmed, and providing appropriate documentation of reasonable transport cost.
NO LABOR, DOWN TIME, TOWING, TRAVEL, LODGING OR ANY OTHER EXPENSE IS COVERED. IN THE EVENT YOU DO NOT AGREE WITH THESE TERMS, YOU MAY PROMPTLY RETURN THE PRODUCT AS PROVIDED BELOW, IN A NEW AND UNUSED CONDITION, WITH A DATED PROOF OF PURCHASE TO THE PLACE OF PURCHASE WITHIN FOURTEEN (14) DAYS FROM DATE OF PURCHASE FOR A FULL REFUND. THE INSTALLATION OF THIS PRODUCT INDICATES THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT AND ACCEPT ITS TERMS AND CONDITIONS.
Further Provisions
These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts of Chandigarh
